Launch38 Terms of Use Agreement

Effective Date: February 5th, 2024

1. Acceptance of Terms

By using Launch38's services ("Services"), you agree to comply with and be bound by the terms and conditions outlined in this Terms of Use Agreement ("Agreement"). If you do not agree to these terms, please refrain from using our Services.

2. Description of Services

Launch38 offers digital marketing services, including but not limited to brand development, website design, content creation, and related services. The specifics of the services provided will be outlined in individual agreements or proposals.

3. User Conduct

You agree not to engage in any activity that may interfere with the proper functioning of Launch38's Services. This includes but is not limited to hacking, data mining, or any other unauthorized access to our systems. You also agree not to engage in any activity that is unlawful, abusive, or violates the rights of others.

4. Intellectual Property

All content and materials provided by Launch38, including logos, designs, and written content, are the intellectual property of Launch38 or its licensors. You may not use, reproduce, or distribute these materials without explicit permission.

5. Confidentiality

Launch38 may have access to sensitive information about your business during the provision of services. Both parties agree to treat such information as confidential and not disclose it to third parties without prior written consent.

6. Payment Terms

Payment terms will be outlined in individual agreements or proposals. Launch38 reserves the right to suspend services in the event of non-payment.

7. Disclaimer of Warranties

Launch38 provides its services "as is" and makes no warranties, expressed or implied, regarding the suitability or availability of its services for your particular needs.

8. Limitation of Liability

Launch38 shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the use of its services.

9. Termination

Either party may terminate the agreement with written notice if the other party breaches any material term of this Agreement or the user fails to follow or complete the guided materials.

10. Rescheduling

A user can reschedule their session date by contacting our support team within 3 business days before the scheduled date. This will incur a $500 reschedule fee and will be rescheduled to the next available spot.

11. Website Ownership

Launch38 will own all website materials until all payments have been made in full.

12. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the state of Georgia.

By using Launch38's Services, you acknowledge that you have read, understood, and agree to be bound by this Terms of Use Agreement.
